Understanding Visa Classifications

O-1, O-2, and O-3 Visa Categories

The O visa classification is designed for individuals with extraordinary abilities and their essential support personnel and family members.

O-1A Visa

Sciences, Education, Business, Athletics

For individuals with extraordinary ability in the sciences, education, business, or athletics (not including the arts, motion pictures or television industry).

Demonstrated extraordinary ability through sustained national or international acclaim

O-1B Visa

Arts, Film & Television

For individuals with extraordinary ability in the arts or extraordinary achievement in motion picture or television industry.

Distinction shown by degree of skill and recognition substantially above that ordinarily encountered

O-2 Visa

Essential Support Personnel

For individuals accompanying an O-1 artist or athlete to assist in a specific event or performance.

Critical skills and experience with the O-1 that cannot be readily performed by a U.S. worker

O-3 Visa

Dependents

For spouses and children under 21 years old of O-1 and O-2 visa holders.

Family members of principal O-1 or O-2 visa holder

 

Who Qualifies?

The O-1 classification is intended for individuals with extraordinary abilities in science, art, education, business, and sports, as well as individuals with extraordinary achievements in film and television who have received national and international recognition for these achievements.

Qualification Requirements

How to Prove Extraordinary Ability

You must provide evidence that you meet at least three of the following criteria to demonstrate extraordinary ability in your field.

O-1A: Science, Education, Business, or Athletics

You must meet at least 3 of the following 8 criteria:

Exceptional achievement: If you have received a major internationally-recognized award such as a Nobel Prize or Olympic Medal, this alone may be sufficient to establish extraordinary ability.

O-1B: Arts, Motion Picture, or Television

You must meet at least 3 of the following 6 criteria:

Higher Standard for Arts: O-1B requires “distinction,” meaning a high level of achievement evidenced by a degree of skill and recognition substantially above that ordinarily encountered.

O-2 Visa

Essential Support Personnel

The O-2 classification is for individuals who will accompany an O-1 artist or athlete to assist in a specific event or performance. The O-2 worker must have critical skills and experience with the O-1 visa holder that cannot be readily performed by a U.S. worker.

O-2 visa is granted for the same period as the O-1 visa holder

O-3 Visa

Spouse & Children

The O-3 classification is for spouses and unmarried children under 21 years old of O-1 and O-2 visa holders. Family members can accompany or follow to join the principal visa holder.

O-3 visa holders cannot engage in employment but may attend school
